SoCal Assemblyman Found Not Guilty in DUI Trial
A jury found West Covina State Assemblyman Roger Hernandez not guilty of driving under the influence.
State Assemblyman Roger Hernandez was found not guilty of drunken driving today for a DUI arrest in Concord in late March, a court clerk confirmed.
Hernandez, 36, D-West Covina, was found not guilty of driving under the influence, and the jury was hung on whether the assemblyman's blood-alcohol level was 0.08 percent, said Cindy Armstrong, clerk for Contra Costa County Superior Court Judge Mary Ann O'Malley.
Both charges were misdemeanors.

The jury began deliberations Friday morning.
Concord police spotted Hernandez at 2 a.m. on March 27 weaving in a car near Concord Avenue and Meridian Park Boulevard and failing to use turn signals, police said.

Hernandez stopped his car in the parking lot of the Crowne Plaza Hotel at 45 John Glen Drive and police said Hernandez, "displayed further objective symptoms of alcohol intoxication."
Officers conducted a field sobriety test, which Hernandez failed, and arrested him, police said.
The 29-year-old passenger in the vehicle was released at the scene.
A laboratory test concluded Hernandez had a blood-alcohol level of 0.08 percent, right at the legal limit, according to police.
