  3. CITY COUNCIL CONSENT ITEMS:
    1. Approving - the minutes for the meeting of April 3, 2012. (No Fiscal Impact) Recommended by City Clerk.
    2. Adoption of Ordinance No. 12-1 - amendment to the Concord Municipal Code (CMC) deleting Chapter 6 (Amusements and Entertainment), Article III (Bingo Games) in its entirety and replacing it with a new Chapter 6 (Amusements and Entertainment), Article III (Bingo Games) to bring the CMC current with state law. Ordinance was introduced on March 27, 2012 by reading of the title and waiving further reading. Recommended by City Clerk.
    3. Approving - the reappointment of Robert Barnes to continue to serve as the City of Concord's representative to the Contra Costa Transportation Authority Citizen's Advisory Committee (CCTA-CAC) for a two year term ending February 28, 2014. (No Fiscal Impact) Recommended by Mayor Leone.
    4. Accepting - the annual General Plan Progress Report and authorizing submittal of the report to the Governor's Office of Planning and Research and to the State Department of Housing and Community Development. (No Fiscal Impact) Recommended by the Planning Commission.
    5. Approving - the following items related to Downtown Landscape Maintenance District, Pine Hollow Landscape Maintenance District, Landscaping and Lighting Maintenance District #3, and the Citywide Street Lighting Assessment District.       (1) Accepting the Engineer's Report for the Downtown Landscape Maintenance District. Resolution No. 12-30 for adoption.

      (2) Accepting the Engineer's Report for Pine Hollow Landscape Maintenance District. Resolution No. 12-31 for adoption.

      (3) Accepting the Engineer's Report for Landscaping and Lighting Maintenance District #3. Resolution No. 12-32 for adoption.

      (4) Accepting the Engineer's Report for the Citywide Street Lighting Assessment District. Resolution No. 12-33 for adoption.

      (5) Ordering improvements in the Downtown Landscape Maintenance District and setting a public hearing for June 5, 2012 at 6:30 p.m. in the Council Chamber. Resolution of Intention No. 12-34 for adoption.

    6. Matter to be set for Public Hearing - on May 8, 2012 at 6:30 p.m. in the Council Chamber to consider a City-initiated Municipal Code Amendment to Division 2 (Board of Appeals); Section 2-291 (Established; membership; compensation of members) revising the section to more accurately conform with the current California Building Code regarding the required number of members and their residency requirements. Recommended by City Clerk.
  4. CITY COUNCIL CONSIDERATION ITEMS
    1. Consideration - of the appointment of three members to the Appeals Board for a term ending February 28, 2017 and one member to a term ending February 28, 2015. Staff is also recommending the Council conditionally appoint a fifth member to a term ending February 28, 2015 as may be supported by the adoption of proposed Municipal Code amendments being introduced on May 8, 2012, and consider appointing an alternate member. Report by Council Committee on Infrastructure and Franchise.
    2. Consideration - of an update on the Association of Bay Area Governments (ABAG) and the Metropolitan Transportation Commission (MTC) Sustainable Community Strategy (SCS) and an overview of the Jobs-Housing Connection Scenario, a process identified in Senate Bill 375 to link the development of a land use plan to the transportation investments included in the Regional Transportation Plan (RTP). Report by Planning Manager, Carol Johnson.
  5. CITY COUNCIL PUBLIC HEARING:
    1. Consideration - of a City-initiated Municipal Code Amendment to the City's Zoning Ordinance, Chapter 122 (Zoning), Article XIII (Inclusionary Housing) to add provisions for increased flexibility to allow developers to pay in-lieu fees, flexibility to allow City to suspend resale restrictions on a case by case basis, and allowance of in-lieu fees to be used for administration of City affordable housing programs. Ordinance 12-2 for introduction. Report by Senior Planner-Housing, Joan Ryan.
