Hillcrest Park Homicide: Alleged Teen Gang Members Plead Not Guilty to Murder, Among Other Charges

Prosecutors say teens, 16 and 19, killed Ever Osorio, 27, of Concord, because his belt was blue - the color of a rival gang.

Two teens accused of murdering a 27-year-old man in Concord last August for wearing a rival gang's color pleaded not guilty to all charges against them Tuesday in Contra Costa County Superior Court.

Tony Dwayne Martin, 19, and 16-year-old Robinson Jair Bermudez -- who is being tried as an adult -- entered the pleas to felony charges of murder, conspiracy to commit a robbery, attempted car-jacking, attempted second-degree robbery and street terrorism, according to the district attorney's office.

Prosecutors said the pair killed Concord resident Ever Osorio the night of Aug. 28 after approaching him and a few of his friends in Hillcrest Park.

Bermudez and Martin allegedly asked Osorio and his friends if they were part of a street gang.

The victim and his friends said no, but the suspects brandished a knife and gun and demanded the victims' car keys and property.

Bermudez allegedly pulled up Osorio's shirt, noticed he was wearing a blue belt and began stabbing him in the head and neck, according to court documents.

Martin then shot Osorio in the chest while his friends fled the area, prosecutors said.

The suspects were arrested a short time afterward after police found them a few blocks away from the park, and Osorio was pronounced dead at John Muir Medical Center in Walnut Creek, police said. 

Martin, an Antioch resident, has also been charged, along with four other alleged gang members in the August slaying of a 16-year-old Oakley boy, prosecutors said.

He pleaded not guilty to the charges.

Both suspects are set to appear in court on March 6 to set future
court dates.
