Concord Bans Outdoor Marijuana Cultivation

The city council voted unanimously Tuesday in favor of an ordinance banning the cultivation of medical marijuana plants in Concord yards.

Medical marijuana users will no longer be able to grow the plant outdoors on any property in Concord, owing to an ordinance that was adopted at Tuesday evening's city council meeting.

The ordinance bans "outdoor cultivation of medical marijuana" in order to properly "maintain and protect the public health, safety and welfare of the citizens of Concord." The ban applies to any Concord resident — whether owning, renting, leasing or occupying property within the city limits.

A number of Concordians spoke at the city council meeting, urging officials to delay or deny the ordinance.

The council discussed the inherent inclusion of a variance to the ordinance, which would allow exemptions to the ban in extenuating circumstances. However, the council was advised by City Attorney Mark Coon and City Manager Valerie Barone that the variance procedure would be tough.

"It would be very difficult to make the necessary findings to grant a variance in most cases," said Barone, adding that there would be "a high standard to meet."

Mayor Dan Helix responded that the variance "may be difficult, but it's there."

The council approved the ordinance in a unanimous vote.
